Elkins Employment Law was founded in 1998 by Cynthia Elkins.

The Firm's emphasis is in the preventative and proactive approach to Human Resource and Employment Law matters, working with clients to stay ahead of the game. The Firm seeks to provide guidance to employers, their management and human resource staff, and to heighten their awareness in all areas of personnel management and employment law matters. In providing litigation defense, the Firm undertakes an aggressive defense of the claim while taking into consideration all related concerns including the impact of litigation on the workplace and the financial impact upon the business. The overall philosophy of the Firm is to provide high quality, cost effective legal representation while meeting the needs of the client.

General Employment Law Advice:

Providing general employment law advice to offer guidance to employers in all aspects of the daily personnel matters which arise, such as disciplinary actions, terminations, layoffs, and reductions in force, the implementation of California and Federal Family and Medical Care Leave of Absence laws, the California Pregnancy Disability Leaves of Absence laws and the combination of several leaves,

Harassment and Related Management Training:

Conducting Sexual Harassment, Discrimination, and Retaliation training for management level employees as required by the State of California. Additional training programs are available covering Wage and Hour Compliance; Interviewing and Hiring issues; Leaves of Absences including Family and Medical Care Leaves, and Pregnancy Disability Leave; Documentation and Disciplinary actions, Suspensions and Terminations.

Employee Handbooks, Personnel Policies, Procedures, Practices and Processes:

Drafting, reviewing, or revising Employee Handbooks designed to meet the specific needs of the company, along with preparation of personnel forms, procedures, and processes for use in conjunction with the Handbook for best personnel practices.

Personnel Audit:

Conducting an initial and then regularly scheduled (monthly or quarterly) audit meetings to address various legal and issues to promote the efficiency of handling personnel concerns and to assist the Company to stay "ahead of the game" to prevent litigation.

Employment Related Contracts:

Preparation of Employment Agreements, Independent Contractor Agreements, Termination and Severance Agreements, Salesperson Commission Agreements, Pay Plans, Non Disclosure, Confidentiality and Trade Secrets Agreements.

Investigation of Employee Complaints:

Conducting timely, neutral, confidential and detailed investigation of an employee complaint relating to allegations of sexual harassment, discrimination, retaliation or other misconduct. Preparation of a detailed summary and report.

Litigation Defense:

Providing defense of employment-related claims in state court, mediations, arbitrations, and administrative hearings before the Division of Labor Standards Enforcement, the U.S. Department of Labor, the Equal Employment Opportunity Commission and the Department of Fair Employment & Housing.
